Cramer: Musk has ‘made a fool’ of the judge overseeing SEC settlement case

Elon Musk has “made a fool” of the judge overseeing the settlement case between the Securities and Exchange Commission and the Tesla CEO, CNBC’s Jim Cramer contended Tuesday.

Musk has backed U.S. District Judge Alison Nathan of the Southern District of New York “into a corner,” Cramer said on “Squawk on the Street.” “This judge either has to get rid of him or say that the SEC is wrong.”

“But Musk has made a fool of Judge Nathan,” he added.

Tesla shares were lower Tuesday after the SEC doubled down on its allegation that Musk “blatantly violated” a settlement with the agency by discussing the company’s production forecasts on Twitter on Feb. 19. Musk defended the comment by saying he was only discussing information he had previously revealed.

The SEC has filed a request to hold Musk in contempt. Nathan will decide if Musk is in contempt and whether he should be punished, which could include additional fines or bar him from running a public company.

Cramer has been critical of Musk ever since the CEO’s Aug. 7 take-private tweet stunned the financial community and Washington regulators. The Tesla CEO abandoned the take-private idea on Aug. 24.

The SEC had eventually settled charges with Musk. He was forced to relinquish his chairman title, pay a hefty fine and get preapproval for his future tweets.

At the time, Cramer said Musk’s “stunts” were ill-advised, and recommend the board put Musk on medical leave.

On Feb. 26, when Musk lashed out against the SEC again, Cramer said Musk should be removed as CEO of Tesla for his comments.

Musk goes after the SEC “as if it’s funny,” the “Mad Money” host said at the time. ” “If this guy is going to attack the SEC, how about removing him? He attacked the SEC.”

Tesla did not immediately respond to a request for comment.

Waiting until age 67 to retire still won’t be enough for working women

Women hoping to retire by age 67 face a tough choice: sock away more cash now or delay retirement even further.

Those were the findings from a recent survey by Aon. The retirement consulting firm analyzed the 2017 records of 1.3 million individual savers, along with data from the Bureau of Labor Statistics.

About 7 out of 10 women participating in the survey will need to overcome significant shortfalls in order to retire at 67, Aon found. Their savings will be short by at least twice their salary.

Female employees are less prepared for retirement because they not only earn less than their male counterparts but also have a longer life expectancy, said Grace Lattyak, associate partner at Aon.

Women in the U.S. generally make about 80 cents to each dollar a man earns. And women have an average life expectancy of about 81, according to the Centers for Disease Control and Prevention. Men have an average life expectancy of about 76 years.

Women also take time out of the workforce to care for family members, which could affect their ability to earn more money and save for retirement, said Lattyak.

Indeed, close to 2 in 3 female workers who took family leave were the primary caregiver for a sick relative, according to data from Pew Research.

“In general, there is a huge gap between the savings that women might have for retirement compared to men,” said Avani Ramnani, a certified financial planner and director of financial planning and wealth management at Francis Financial in New York.

On average, women should have 11.6 times their last annual salary saved by age 67 in order to retire, according to Aon’s analysis.

However, based on current savings rates, they’ll only have an average of about 7.6 times their salary saved by that age. They’ll face a steep shortfall.

In order to beat that hurdle, female workers will need to either defer their retirement or save more money during their working years.

There are different approaches to saving up that money.

Aim to contribute up to 15 percent of your salary each year in your 401(k), said Ramnani.

Also, consider working with a financial planner who can help you figure out how much you need to have saved by the time you retire, she said.

“You should estimate how much your expenses are going to be for each year of retirement, and work backwards to see how much you’ll need at the beginning of retirement,” said Ramnani.

This will give you a sense of how much you need to save each year in order to meet that goal.

Finally, saving is only part of the equation. You should invest that money so that it grows over time.

“Women tend to shy away from investing, but keeping the money in a bank account will not make it grow the way you need it to grow,” said Ramnani.

Your workplace 401(k) will give you a good start, she said. Your contributions are made on a pretax basis, and they grow tax-deferred until you retire and it’s time to withdraw the money.

For every parent like Felicity Huffman and Lori Loughlin who tried to buy their kid’s way into college, there are a slew of others who can barely afford it.

“We are in that funny trap where we don’t qualify for aid but we also don’t have $70,000 a year to spend on private college,” said Robin Coccomo, 42. Her oldest son, Paul, will be a freshman in the fall and she also has two other children not far behind.

“What I offer him, I also want to be able to offer the other two.”

Paul Coccomo, 18, wants to study engineering and has already been accepted at eight institutions for next year, including the University of Connecticut in his home state. He is still waiting to hear from seven more colleges, one of which is MIT — his top choice.

However, all of those schools are expensive. The cost for tuition plus room and board at a four-year private school hit $48,510 for the current school year, according to the College Board. At public four-year institutions, the total was about half of that, though still $21,370 on average.

To bridge the gap, about two-thirds of all full-time students receive aid, which can bring the net price way down. “If we can negotiate a little bit of a bump in aid, it would make it manageable,” Coccomo said.

Schools are often receptive to appeals for more aid; they just don’t advertise it, experts say.

“We’ve had students increase their aid by as much as $120,000,” said Zack Perkins, the co-founder of CollegeVine, a college admission guidance site.

“That initial aid offer is the starting point,” he said. “It’s more like an opening bid.”

The best way to make such a request is to write a letter to the school’s financial aid office, Perkins advised.

Review the letter

But first, make sure you understand the financial aid award letter — particularly the difference between scholarships and loans, whether those funds are renewable for all four years and if they come with contingencies such as maintaining a certain grade point average.

Then, frame the conversation depending on the type of aid you are seeking. There are need-based appeals and merit-based appeals, said Davin Sweeney, a director of college counseling at Collegewise in New York.

If there are need-based issues beyond what was noted in the financial aid paperwork, such as an older sibling who moved back home after college, care for elderly grandparents, increased health-related expenses or the loss of a job, those should be explained to the school and documented, if possible.

Alternatively, if the financial aid packages from other, comparable schools were better, that is also worth bringing to the school’s attention in an appeal for more merit aid.

“Universities are very open to these conversations, if presented in the right way,” Perkins added. “You’d be surprised at how much additional aid you can secure.”

Roughly a third of appeals are honored at most schools, according to Robert Franek, The Princeton Review’s editor-in-chief and author of “The Best Value Colleges.”

With prices steadily rising, “the college understands how important the cost of attendance is and they want to make it work,” Sweeney said.

These days, 7 in 10 seniors graduate with debt, owing about $30,000 per borrower, according to the most recent data from the Institute for College Access & Success. (Tack on interest and that balance can balloon over time.)

All in, student debt reached a record $1.5 trillion last year, according to the Federal Reserve.

In a recent poll, the majority of students and parents said that, when it comes to college, their biggest concern was the “level of debt to pay for the degree.” Ninety-nine percent of respondents also said financial aid would be somewhat, very or extremely necessary, according to The Princeton Review’s College Hopes & Worries survey.

Before taking on such a significant financial commitment, really consider what you can comfortably afford, Sweeney advised.

“It’s an incredibly personal decision for every family to gauge whether something is worth it,” he said. “That goes for the milk you buy at the store to your college decision.”

A degree that will leave you with six figures of student loan debt “is definitely approaching too much,” he added.

Market sees nearly 50% chance of a Fed rate cut by the end of January 2020

Markets are becoming more convinced that the Federal Reserve will be more accommodative on interest rates.

The fed funds futures market is assigning a 48.9 percent probability of at least one rate cut by Jan. 29, according to the CME’s FedWatch tool, which has been a reliable gauge of the Federal Open Market Committee’s actions.

Futures contracts are also implying a 39 percent probability of a rate decrease by Dec.11, up from only 23 percent before the Fed’s policy decision at 2 p.m. on Wednesday.

The Fed left interest rates unchanged on Wednesday and also indicated that no more hikes will be coming this year. The central bank’s policymaker took a sharp dovish turn from policy projections just three months earlier when they estimated two rate hikes would be appropriate in 2019.

The move came along with reduced expectations in GDP growth and inflation and a bump higher in the unemployment rate outlook. The central bank also said it’s ending its balance-sheet reduction in six months. The Fed will begin in May to taper the amount of proceeds it allows to roll off each month and will end the program in September.

The CME computes the probability of a rate hike by taking the end-month futures contract, subtracting the level at the beginning of the month, and dividing that by 25 basis points, which is the assumed level of each rate hike.

Kmart Corp. has agreed to pay $32.3 million to the United States to settle allegations that in-store pharmacies overcharged several federal health care programs, the U.S. Department of Justice has announced.

The settlement agreement is part of a larger $59 million settlement that includes a resolution of state Medicaid and insurance claims against Kmart, the DOJ said.

According to the Justice Department, Kmart, a wholly owned subsidiary of Hoffman Estates, Illinois-based Sears Holdings Corp., allegedly violated the False Claims Act by offering discounted generic drug prices to cash-paying customers, but didn’t disclose those cheaper prices when reporting the drugs’ usual and customary prices to Medicare Part D, Medicaid and Tricare, which is the health program for uniformed service members and their families.

Hotel Leela Venture locked at upper circuit on sale of hotel properties for Rs 3,950 cr

The share price of Hotel Leela Venture was locked at 5 percent upper circuit after the company decided to sell its hospitality and hotel operations business on slump sale basis to Brookfield.

There were pending buy orders of 1,059,544 shares, with no sellers available.

The company in its BSE release said that it has approved the execution of a Framework Agreement with BSREP III India Ballet Pte. (Brookfield) for sale and transfer of four hotels properties in Bangalore, Delhi, Udaipur and Chennai on a slump sale basis as a going concern for Rs 3,950 crore.

It also includes the hospitality and hotel operations business of the company and 100 percent shareholding of the company in Leela Palaces and Resorts that owns property and holds licenses for the development of a hotel in Agra.

At 11:03 hrs Hotel Leela Venture was quoting at Rs 11.63, up Rs 0.55, or 4.96 percent on the BSE.

However, most of that growth was driven by new restaurant openings, since its comparable restaurant sales slid 2.3% — compared to expectations of 0.5% growth. Zoe’s blamed the drop on a slight calendar shift, adverse weather conditions, lower dine-in traffic, and a decline in its average single person check.

Opening new restaurants amid declining sales at existing ones is a costly strategy. That’s why Zoe’s posted an adjusted net loss of $2.6 million, or $0.13 per share — which missed estimates by $0.13 and compared poorly to its net profit of $0.3 million, or a penny per share, in the prior year quarter. Its adjusted EBITDA also tumbled 31% to $5.6 million.

    Luna Innovations Incorporated (NASDAQ:LUNA) rose 16.6% during trading on Monday . The company traded as high as $4.14 and last traded at $3.93. Approximately 651,876 shares changed hands during mid-day trading, an increase of 1,262% from the average daily volume of 47,854 shares. The stock had previously closed at $3.37.

Snap may have doubled this year, but don’t buy because of ‘FOMO,’ says technician

It wasn’t a snap decision.

After two years on the sidelines, BTIG analyst Rich Greenfield upgraded shares of social media company Snap to a buy rating Thursday. The stock surged more than 12 percent on Greenfield’s call that the name can reach $15 based on advertising growth.

Snap has more than doubled in 2019, gaining nearly 105 percent. But the move followed what was a steep slide in the fourth quarter, and the shares are still roughly 38 percent from their 52-week high last March.

The stock has undoubtedly been on a tear, but two market watchers said to be very careful here.

“[D]o not chase a position on a fear of missing out,” Bill Baruch, president of Blue Line Futures, said Thursday on CNBC’s “Trading Nation.” From a technical standpoint, he contended the stock faces “tremendous resistance with the trend line from its high.”

He noted that if the stock could break the resistance and close above $12, tail wind momentum could lift it to $14 – $17.

But on the flip side, Baruch believes the name could just as easily reverse course and fall back to $7. So given the potential downside, he argues to “stick to your game plan” and says “don’t chase it.”

In an effort to attract new users Snap has undergone a series of design changes, among other things, but growing competition from Facebook and Twitter as well as a number of high-level executive departures have continued to plague the stock over the last year.

Mark Tepper, president and CEO of Strategic Wealth Partners, said he wouldn’t be a buyer of Snap until the company can prove it can appeal to a broader user base.

He said that it has a “cool product” and that it’s the “most preferred social networking program among teenagers,” but the problem, according to Tepper, is that teenagers are not the ones with money to spend. This means the platform is less valuable from an advertising standpoint.

“[T]eenagers don’t have the deepest pockets and they [Snap] are really struggling to attract the 35-plus crowd. Those are the people with the spending power,” he said, adding that “[t]hey’re seeing revenue per user that’s about half of what Twitter realizes.”

The stock would be “intriguing” at $6, Tepper said, but for the time being, and after the surge higher, he said it’s a tough name to get behind.
