    It hasn’t been an easy time for investors inRegeneron Pharmaceuticals (REGN) recently…and today’s price action is likely to reinforce the sense of whiplash they must be feeling.

    What do I mean? Regeneron’s dropped 14% during the last three months, the result of a patent suit with Amgen(AMGN) over its anti-cholesterol drug Praluent, which a judge had set it wouldn’t be able to sell in the U.S.Then last night, there was finally good news: Ajudge ordered a stay, which would allow Regeneron to sell Praluent, and resulted in a 2% pop in its shares last night after the market close. But then Regeneron reported earnings, and while profits of $3.04 cents a share metthe Street consensus, Regeneron missed on sales and offered disappointing guidance. That caused Regeneron shares to sink 2.1% in pre-open trading.

    Fast forward to this afternoon, and and now they’re up nearly 3%. Credit Suisse analyst Alethia Young and team explain why the injunction outweighs the earnings:

    Company issued Eylea guidance for 2017- they guided single digit
    percentage growth over 2016. Consensus had been for 12% growth and we
    had modeled 11% growth.

    EPS for 4Q came in at $3.04 in line with $3.04 consensus. Since the company has already provided OpEx guidance for 2017 and the Eylea 4Q estimate ahead of today we think earnings are less of a focus.

    We are curious where in the single digit percentage growth for Eylea the company means- 9% YoY growth wouldnt be too far from consensus vs. 3%
    growth…

    As we wrote last night, we would expect shares to trade up due to the injunction stay. We would expect shares to be up 2-4% from the injunction stay, but the effect might be muted somewhat by the Eylea guide. We would guess shares might be up 1 to 3% today.

    Regeneron Pharmaceuticalsdropped 5.8% to $358.68 today, while the S&P 500 rose 0.4% to 2,276.98.

    Yesterday, after markets closed, it was announced that US Federal District Court Judge Sue Robinson ruled to issue a permanent injunction against Praluent, the PCSK9 mAb for hypercholesterolemia from partners Regeneron and Sanofi, due to infringement of patents from Amgen. The court has imposed a 30-day suspension (stay) on the injunction to allow for settlement or appeal of the District Court decision. Sanofi and Regeneron have announced their intent to appeal the ruling to the US Court of Appeals for the Federal Circuit (CAFC). The injunction decision is consistent with our counter-consensus published views communicated on 25 January 2016 (“Downgrade to Sell on evidence of likely infringement of Amgen’s PCSK9 patents”) and subsequently. Based on consultation with expert legal counsel, we now put >75% probability Amgen will prevail on appeal and/or Praluent is ultimately removed from the US market, and/or Amgen achieves a settlement substantially in its favor. We currently model $3.3 bn in non-risk-adjusted 2022E US revenues for Praluent, while consensus models $1.2 bn in 2022E US revenues. We reiterate our view from 25 January 2016 to preferentially own Amgen, The Medicines Company (MDCO) (Buy), and Alnylam (ALNY) (Buy) over Regeneron for exposure to PCSK9 inhibitor market dynamics as outcomes trials approach.

    Everything that Viva Entertainment Group Inc (OTCMKTS:OTTV) was offering via its app as of yesterday just got expanded today. Per this morning’s press release, all the digital content from FlixFling is going to be available on the Viva over-the-top television (and music) streaming platform.

    The product is called Viva Middleware. The software/platform allows anyone to get into the over-the-top television business like Netflix and Hulu already are. Telecom service providers, media websites, universities, and pretty much anyone else can custom-build their own IPTV service, and collect subscription fees and/or ad revenue for doing so. Viva does all the back-end work, while the seller collects the customers.

    The trick is simply filling the pipeline with content, and at the same time, convincing customers that there’s enough quality content at the source to become a paying subscriber. And in this case, the fact that the app works on any operating system or any device is a key selling feature.

    Viva Entertainment Group has already been curating content for a while now, and has a nice library including a huge number of radio stations. That content took a huge leap forward today, however, with FlixFling being added to the mix.

    If it rings a bell for OTTV shareholders, it should. FlixFling is streaming media company started by Thomas Ashley, who just so happened to join the OTTV Board of Directors last week.

Indeed, the company has already announced a joint venture with Oi2 Media – the United States’ biggest distributor of Latino-centric digital content – to create an OTT product catering to a specific segment of the nation’s demographic. The possibilities are endless though… including such a service from Viva Entertainment Group itself.

    That is, in fact, what’s been happening. Over the course of the past several months the company has been in discussions with several digital video content providers and venues, adding their content to Viva’s platform. Last month it added FlixFling content to its already-extensive library. Today, it announced it would be piping in content from TikiLIVE, which offers online access to an impressive array of television programs that many consumers presumed were only available with a cable subscription.

    The phrase “over the top television” or “OTT” for short, aren’t exactly new terms. The phrase/abbreviation was coined shortly after Netflix, Inc. (NASDAQ:NFLX) became a viable alternative to traditional cable television subscriptions a little less than a decade ago. The over-the-top battle didn’t get heated, though, until the past few months. But, now that some more gladiators are in the arena, sparks are starting to fly.

    They’re still flying too, and should do so for a while if a small startup called Viva Entertainment Group Inc (OTCMKTS:OTTV) has anything to do with it it. See, while Netflix, Hulu — jointly owned by Time Warner, Walt Disney Co (NYSE:DIS) and Twenty-First Century Fox Inc (NASDAQ:FOXA) — and a whole slew of other new players in this market may want to take notice of this up-and-comer. At the same time, investors may want to take a step back and look at where the real money in the OTT business is going to be made over the course of the next several years. OTTV plays a prominent role in that picture.

    Contrary to popular belief, Netflix isn’t the dominant name it used to be in the Internet-delivered television industry. Yes, it was the first on the scene as such was was able to carve out the biggest piece of the market. It’s largely become a commoditized business in the meantime though.

    For example, outside of Hulu and Netflix, CBS Corporation (NYSE:CBS) has jumped into the fray with a service called CBS All Access. The product allows subscribers -for a nominal monthly fee – access a variety of CBS programming via the Internet. HBO, from Time Warner Inc (NYSE:TWX), has found some measurable success with its subscription-based Internet television service called HBO Go.

    Don’t look for any news to explain the big 73% surge Viva Entertainment Group Inc (OTCMKTS:OTTV) dished out on Monday – you won’t find it, because there wasn’t any. Rather, OTTV shares popped all on their own.

    The knee-jerk reaction may be to presume OTTV stock is destined to roll back just as quickly as the rally materialized. And, that may well be what’s in the cards. Before looking past Viva Entertainment Group as an investment opportunity that’s dead money until further notice though, Monday’s mostly-overlooked action may be a huge bullish clue.

    For the unfamiliar, the company’s product is called Viva Middleware. The software/platform allows anyone to get into the over-the-top television business like Netflix and Hulu already are. Telecom service providers, media websites, universities, and pretty much anyone else can custom-build their own IPTV service, and collect subscription fees and/or ad revenue for doing so. Viva does all the back-end work, while the seller collects the customers.

    The trick is simply filling the pipeline with content, and at the same time, convincing customers that there’s enough quality content at the source to become a paying subscriber. And in this case, the fact that the app works on any operating system or any device is a key selling feature.

    Viva Entertainment Group has already been curating content for a while now, and has a nice library including a huge number of radio stations.

    The stock, though, hasn’t exactly been rewarding even though the company’s back-story has been compelling. That paradigm shift may have changed on Monday.

    Take a look. Out of nowhere, a ton of volume materialized on Monday… most of it bullish. There’s still a ton of ground left to make up, to be sure, but this is interesting.     It’s almost here. Viva Entertainment Group Inc (OTCMKTS:OTTV) is about to unveil its long-awaited over-the-top (OTT) television platform that’s poised to disrupt the entire television industry even more than it’s already been up-ended.

    And it’s going to debut that technology in style. On December 13th, at the Riviera Hotel in South Beach Miami, OTTV will be hosting a launch party to debut its Viva OTT platform. Not only will the event give guests a chance to see and use the over-the-top television platform, they’ll be dazzled by performances by Soleil J and Jorge Moreno.

    The product is called Viva Middleware, which in simplest terms is a turn-key technology that allows anyone to get into the OTT business with their own customized over-the-top television service.
